The Ombudsman has launched an investigation into the disciplinary proceedings against a SEPE official for assisting citizens without an appointment. In other words, the Ombudsman is examining whether the penalty is proportionate and whether it violates your right to receive assistance. The case has reignited a problem that many foreigners face on a daily basis: the difficulty of getting an appointment at immigration offices or at the SEPE itself.
It’s nothing new, really. The requirement to make an appointment for almost any procedure was introduced during the pandemic and has stuck around. But when the system fails—appointments are full, the website crashes, deadlines are looming—the only option left is to go in person. And there you run into officials who, like this one at the SEPE, risk disciplinary action for doing their job. So, you see.
For foreigners, things get even worse. Renewing a residence card, applying for permanent residency, or requesting an EU certificate requires an appointment that often takes months to secure. And if your document expires, you can end up in an irregular situation through no fault of your own. The Ombudsman has intervened before on immigration issues, and this new complaint suggests that the appointment system isn’t working. Of course, we’ll have to see what happens.
What can you do if you find yourself in this situation? First, save all evidence: screenshots of the website showing no available appointments, emails, and your attempts to book. Then, file a formal complaint with the Ombudsman (defensordelpueblo.es) or, if it’s in your region, with the regional ombudsman. You can also seek free legal advice from immigrant associations. Take action—don’t get left hanging.
The case of the SEPE official shows that even public employees know the system is unsustainable. But until it changes, you’re the one who loses out. The institution that defends your rights has already brought this to light. Don’t let it be in vain.
