Imagine you’ve been in Spain for some time and need to regularize your status. Until now, many people thought they could apply for asylum and, at the same time, apply for residency through other channels, such as work or family ties. Well, the Supreme Court has drawn a clear line: if you apply for asylum, your application for regular residency goes down the drain. In other words, you can’t have both at the same time.
This ruling has thrown a wrench in the plans of more than a few people. That’s because many people used asylum as a fallback option: if I don’t get it, at least I’ll try for regular residency. Well, no. The judges are clear on this: the two are incompatible. So if you were counting on that dual approach, you can forget about it now.
In practice, this means that if you’ve already applied for asylum and have also submitted an application for residency based on employment or ties to the country, the second one can be denied outright. And be careful, because even if your asylum application is denied, it’s not clear that you’ll be able to switch to the regular residency track—you might no longer meet the requirements. In other words, you’ll be stuck in limbo.
So, what should you do? If you haven’t applied for asylum yet and your goal is residency, think carefully about which route is best for you. Don’t take the fast track through the asylum process if your case doesn’t actually qualify for international protection. And if you’ve already applied for asylum and now want to try for ordinary residency, you may have to withdraw your asylum application first and then try your luck. But be careful—that’s not without risks. It’s best to talk to a lawyer who can run the numbers for you before taking that step.
Ultimately, the Supreme Court has closed the door. They may issue some guidance in the future to clarify specific cases, but don’t get your hopes up. You’re the one who has to handle your situation. So get well-informed, seek advice if you need it, and make a rational decision.
